1. Agreement
By accessing or using Mow Ops, you agree to be bound by these Terms & Conditions. If you do not accept them, do not use our services.
2. Services
Mow Ops provides software for:
- Job and schedule management
- Client/property record management
- Route optimisation
- Invoicing and payments
- Messaging and notifications
- Accounting synchronisation (Xero/MYOB)
- Administrative and reporting features
We may update or modify services at any time.
3. User Responsibilities
You must:
- Provide accurate information
- Maintain the confidentiality of login credentials
- Ensure all data you enter has been lawfully obtained
- Use the platform in compliance with Australian law
You must not:
- Attempt to breach system security
- Misuse API endpoints
- Reverse-engineer any part of the system
- Use the service for unlawful, fraudulent, or harmful purposes
4. Subscriptions & Payments
- All subscription fees are processed via Stripe
- Fees are charged in AUD unless otherwise stated
- Subscriptions renew automatically until cancelled
- Failed payments may result in account suspension
- Refunds are at our discretion, subject to Australian Consumer Law
5. Integrations
By connecting external systems (e.g., Xero, MYOB, Stripe), you acknowledge:
- Third-party outages, API limits, or data discrepancies are outside our control
- You remain responsible for your own accounting and financial compliance
- You grant Mow Ops permission to access and store required integration data
- We are not liable for incorrect data caused by external systems
6. Data Ownership & Licensing
- You retain ownership of all data you upload or generate
- You grant us a licence to store, process, and use your data solely for providing the service
- We may retain backups for compliance and disaster recovery
7. Intellectual Property
All software, algorithms, text, graphics, and documentation remain the exclusive property of Mow Ops. You may not copy, distribute, or adapt the software without written consent.
8. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, consequential, or special damages
- We are not responsible for losses caused by third-party providers (Stripe, Xero, MYOB, AWS, Google, SMS providers, etc.)
- Our total liability is limited to the subscription fees paid in the preceding 3 months
Nothing in this agreement excludes rights under the Australian Consumer Law.
9. Suspension & Termination
We may suspend or terminate accounts for:
- Breaches of these terms
- Security concerns
- Fraud or misuse
- Non-payment
- Regulatory obligations
Upon termination:
- Access to the service ends
- We may retain necessary records for compliance
- You may request data export if your account is in good standing
10. Governing Law
These Terms & Conditions are governed by the laws of Western Australia. Any disputes are subject to the exclusive jurisdiction of WA courts.
